These Terms of Service ("Terms") govern your access to and use of PromptEval (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You may use the Service only if you:

  • Are at least 18 years old; and
  • Have the legal authority to enter into these Terms.

2. User Responsibilities

You agree that you will:

  • Provide accurate account information and keep it up to date.
  • Maintain the confidentiality of your login credentials.
  • Be responsible for all activity that occurs under your account.
  • Use the Service in compliance with applicable laws and regulations.
  • Ensure that any data you submit to third-party AI providers through the Service complies with their terms of use.

3. Bring-Your-Own-Key (BYOK)

If you connect external AI model providers using your own API keys:

  • You authorize PromptEval to use those keys solely to execute requests that you initiate or configure.
  • You are solely responsible for any fees, charges, or limits associated with those keys and providers.
  • PromptEval is not responsible for overages, billing issues, or other consequences arising from your use of external APIs.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, harmful, or abusive purpose.
  • Attempt to gain unauthorized access to any systems or networks.
  • Probe, scan, or test the vulnerability of the Service without permission.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Submit content that infringes on the rights of others or includes personal data of third parties without proper consent.
  • Resell, sublicense, or otherwise exploit the Service without our consent.

5. Intellectual Property

PromptEval retains all rights, title, and interest in and to the Service, including the underlying software, design, and documentation, and all associated intellectual property rights.

You retain ownership of your prompts, uploaded data, and any outputs generated for your inputs, subject to any applicable terms of the third-party AI providers you use. You grant PromptEval a limited license to process this content solely for the purpose of providing and improving the Service.

6. Service Availability and Changes

We provide the Service on a commercially reasonable basis, but we do not guarantee that it will be available at all times or free from errors.

  • We may modify, suspend, or discontinue parts of the Service at any time.
  • We may enforce rate limits, quotas, or other usage controls.
  • We may suspend or terminate your access if you violate these Terms or if your use creates risk or potential legal exposure for us.

7. Payment and Plans

Some features of the Service may be offered on a paid basis in the future, including subscriptions or usage-based billing. When you purchase a paid plan:

  • Fees and billing terms will be presented at the time of purchase.
  • Subscriptions may automatically renew unless you cancel them in advance.
  • All fees are generally non-refundable unless required by law.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free.
  • The outputs generated by AI models will be accurate, complete, reliable, or suitable for any particular purpose.
  • The Service will meet your expectations or requirements for legal, financial, medical, or other professional use.

9. Limitation of Liability

To the maximum extent permitted by law, PromptEval and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use the Service;
  • Any conduct or content of any third party;
  • Any content obtained from the Service; or
  • Unauthorized access, use, or alteration of your transmissions or content.

In any case, our total liability for all claims relating to the Service will be limited to the amount you have paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, if any.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if we reasonably believe that you have violated these Terms, created risk or possible legal exposure for us, or if we decide to discontinue the Service.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles, unless otherwise required by the laws of your jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice within the Service. The updated Terms will be effective as of the date indicated at the top of the page. By continuing to use the Service after the changes become effective, you agree to the updated Terms.
